Liability
All
suppliers, agents, parent, subsidiary affiliated
or associated companies or
representatives
dealing with Safari Rangers (SR) are legal and registered with various
organizations within South Africa i.e. SATSA, to give
SR the necessary accreditation and you
the Customer, the necessary relief that
you are booking with a legitimate company.
Neither SR or any supplier, agent, parent, subsidiary affiliated
or associated company or
representative shall be liable for any
death, loss, injury of or damage to the Customer or his belongings
what-so-ever and however arising and the Customer
so indemnifies SR
accordingly.
Change of Arrangements, Route and Price
In the event of there being a delay or unscheduled extension to
the travel arrangements caused by the
Customers flight delays,
bad weather, strikes or any other cause which is beyond the control
of SR, it is understood that expenses relating to these delays
or unscheduled extensions (late entrance pass, hotel accommodation
etc.) will be for the Customers account.
In the unlikely event that
SR is unable to provide the accommodation confirmed to
the Customer the policy is always to offer the Customer
alternative accommodation of similar
classification, wherever possible in the same area.
While every
effort is made to keep published itineraries, SR reserves the
right to make changes for the Customers convenience. In some cases,
conditions such as the weather, accommodation or game movements
may necessitate an alteration to the tour itinerary and this does
not constitute any reason for a refund.
Insurance
It is strongly recommended that the Customer take adequate insurance
cover in the event of cancellation due to illness, accident or
injury. Insurances against personal accident, medical assistance,
personal liability and loss of baggage are also recommended. (Please
note that the aforementioned cover is merely a suggestion and
not an exhaustive list). It shall not be obligatory upon SR to
affect insurance for the Customer except upon detailed instructions
given in writing by the Customer and all insurance affected by
SR pursuant to such instruction will be subject to such exceptions
and conditions as may be imposed by the insurance company or underwriters
taking the risk, and SR shall not be obliged to obtain separate
cover for any risks to be excluded.
SR shall not be under any
obligation to affect a separate insurance for each Customer but
may declare it on any open or general policy. Should the insurers
dispute their liability whatsoever in relation thereto notwithstanding
that the premium of the policy may not be at the same rate as
that charged by SR or paid to SR by the Customer? SR will not
be responsible if the Customer fails to take adequate insurance
cover.
Travel Documents
The responsibility to advise all Customers to have in their possession
current and valid passports, visas, vaccinations and inoculation
certificates and the like, where required, is not that of SR alone.
SR shall not be responsible for any losses of any nature arising
from SR's failure to ensure that the Customers are timely advised
of the necessity of complying with such requirements excluding
consequential losses.
SR shall not be responsible for problems
arising as a result of the supplying of insufficient and/or incorrect
information and/or the refusal of a Customer to furnish travel
documents or information to it timely not for the refusal by foreign
or South African authorities to issue travel documentation for
a particular person or other matters beyond its control.
Cancellation
SR reserves the right to cancellation costs, the amount of which
depends on the total costs incurred in cancelling the Customers safari with suppliers,
agents etc.
On SR receiving a cancellation request from the Customer, SR will notify the Customer of the total cancellation costs. A two (2) day period will be allowed in case the booking is to be reinstated. After the two day reinstate period, should the Customer not instruct SR to reinstate the booking, SR will only then cancel the booking.
Any cancellation costs incurred by SR, which exceeds the deposit amount will be for the Customers account. The minimum cancellation
costs, which may be imposed are 50% of the deposit. If cancelled
within Fourteen (14) days of departure date the full booking deposit
is forfeited including any further cancellation costs from suppliers. If cancelled within Seven (7) days of departure date, the
total safari tour cost is forfeited by the Customer. Failure to cancel will also
result in the total safari tour cost being forfeited by the Customer.
Law and Cancellation
South African law governs this agreement. The parties hereby consent
to the jurisdiction of the appropriate Magistrates Court in regard
to any action or proceedings based on or arising from the Trading
and Booking Conditions.
